It's been interesting the amount of ToS that are busily changing the arbitration clause to make sure that, if lots of people all file similar claims, they will be handled in a cheap-for-the-company way. Obviously, the point of forced arbitration was to disallow class-action lawsuits, but the, "everyone does arbitration!" was a nice workaround to make wrongdoing less profitable. Regardless, it's unfortunate on the amount of contracts where we have very little ability to get a contract that's actually in the interest of both parties. I can't go to a competitor if there is no competition on the points I care about. But, yes, until McDonald's decides that everyone has to agree to a ToS before engaging with the store, avoiding the, "you inherently lose any rights you thought you had" contract does seem like a good idea. Anyway, no issue for me -- I still have the Play store set as in the US, which has stopped me from installing a variety of things region-locked to Germany. And, on that note, I'm sad that the Payback card has become less and less useful, as businesses have slowly gone the US route of having a card for every store, rather than one that worked across stores.
