A man charged with murder over the high-profile death of dairy worker Janak
Patel has been granted a stay of proceedings.


Patel, 34, was attacked outside the pink-painted Rose Cottage Superette in
the Auckland suburb of Sandringham on November 23, 2022.


Nationwide protests followed amid heightened concerns over retail crime.


Three men were charged with murder and one, Frederick Hobson, has pleaded
guilty to the killing.


But today it was revealed the case against another of the defendants won't be
going ahead.


The Solicitor-General has entered a stay of proceedings for Henry Fred as
he's terminally ill, Justice Graham Lang revealed in the High Court at
Auckland this morning.


A stay of proceedings mean that further court business related to the
individual's case is halted.

With Fred's stay and Hobson's admission only one defendant remains: Shane
Tane, who has pleaded not guilty.


Tane is set to go to trial late next month.
