If anyone doubts how presidents shape our federal courts for generations to come, they need only look to Texas. Trump appointee and District Court Judge for the Northern District of Texas Matthew Kacsmaryk is poised to revoke the FDA’s approval of mifepristone, which is used in combination with misoprostol for medication abortion. If he does, an appeal would land in the Fifth Circuit Court of Appeals—the most conservative in the country—potentially triggering another major abortion access fight at the Supreme Court. Patients usually take the combination of mifepristone and misoprostol to end a pregnancy at up to 10 weeks. The mifepristone is used to block progesterone, which helps maintain a pregnancy. Then, misoprostol is taken to induce contractions and expel the pregnancy from the uterus. Misoprostol-only abortions are possible, but the combination of medications is technically more effective. Abortion pills are a safe and effective way to end an early pregnancy in the comfort of one’s own home, and they have become particularly crucial after Roe v. Wade was overturned. However, an appeal to reason won’t stop anti-abortion extremists who are hellbent on cutting off abortion access in every way possible. If Kacsmaryk rules against the FDA, it would send shockwaves across the entire country. Just because abortion is legal in certain states doesn’t mean methods of abortion are protected. We need those explicit protections—namely from the Department of Justice, which has been investigating legal avenues to retain access to medication abortion.
