Allegations of Discrimination=Defamation (Florida HB991) No, I’m not making this up. A lot of HB991 is targeted at journalists and I leave those parts to them (they’re really bad); the section I’m focusing on is this: An allegation [i.e., making an allegation] that the plaintiff has discriminated against another person or group because of their race, sex, sexual orientation, or gender identity constitutes defamation per se… Statutory damages for a violation are set at $35,000. The problems with this are too deep to list. Track the bill here. It passed favorably out of the Civil Justice Subcommittee yesterday and is now in the Judiciary committee. Health Care Bans for Minors. In the last two days both Georgia (SB140) and Kentucky (HB 470) have passed bills that would ban surgical or hormonal treatments for minors who have gender dysphoria. Both bills prohibit the provision of surgical treatments or hormone replacements for minors with gender dysphoria, and both provide licensing penalties for doing so. Both also make exceptions for intersex folks. Georgia’s bill added a new amendment yesterday adding criminal liability for doctors who violate its provisions but we don’t know the language yet because of shenanigans. See below. Kentucky, though, goes much further than Georgia’s relatively simple bill. Kentucky would impose joint and several liability for damages and costs on any provision of surgical or hormonal treatment—including puberty blockers—to minors. That liability would extend to insurers, and the bill would prohibit state Medicaid, CHIP, and health insurance for public employees from covering gender transition care. Enforcement of these provisions can be made by the Kentucky Attorney General. Kentucky would also prohibit a sex marker change on a birth certificate for a minor, and any name change for a minor made to effect a gender transition. Georgia’s bill, SB140, already passed the Senate and passed out of the House Public Health Committee yesterday, and the only way we know that is through local reporting, because the Georgia Legislature’s website has been down all day. I call shenanigans. Track the bill here. Kentucky’s bill, HB470, is moving over to the Rules committee. Track it here. Preferred Pronoun and Title ban and Sex Ed ban. Florida is back on the board, taking the time to try and legislate the elimination of preferred pronouns in public schools. THOU SHALT USE THE PRONOUN AND TITLE CORRESPONDING TO THE SEX MARKER ON YOUR BIRTH CERTIFICATE. This applies to public school employees, students, and contractors. They can’t be required to use a pronoun or title if it “doesn’t correspond to that person’s sex” and teachers can’t provide the students a pronoun/title that doesn’t correspond to their sex. Oh and you can’t even ask students to provide preferred pronouns or titles. Also: no education on sexual orientation or gender identity until you hit 9th grade. Good luck, kids. HB 1223 passed favorably out of committee yesterday. Track it here. Redefining ‘Sex’, forgetting that Intersex people exist Finally, in a similar manner to the bill described out of Montana yesterday, Tennessee is doing the exact same thing by redefining “sex” throughout the state’s code. “Sex” means a person’s immutable biological sex as determined by anatomy and genetics existing at the time of birth and evidence of a person’s biological sex. Similar problems apply here, though I’d have to go through the whole damn Tennessee code to figure out how bad it could affect intersex people or folks who have previously transitioned/changed gender markers.
