The question that heads the diary was one posed by G2geek in one of annielli’s diaries about a potential gag order in the upcoming case in Manhattan. This is a good question, one that had crossed my mind last week. After news broke of the indictment, I broke my fast on broadcast news (trying to stay closer to print sources) and took in some MSNBC Thursday and Friday. I happened to catch a bit of Lawrence O’Donnell’s show Friday evening. He was similarly incredulous as G2geek, wondering how Donald Trump could possibly hope to win his case if he keeps (I’m paraphrasing here) mouthing off to the press. Threatening judges, assaulting the DA… Donald Trump seems to be doing himself no favors. Unless he has no intention of winning the case. Not outright, anyway. I may be entirely mistaken here, but it seems that if a person were going for a mistrial, they would do many of the things that Trump is doing right now. Donald Trump, if I’m correct, sees a mistrial as his best bet. Serial mistrials would (may?) lead to prosecutors dropping the case due to the costs involved, were this a case involving a regular, low- to mid-level defendant. I don’t think that would be the cards in Trump’s case, but what other option for Trump really is viable? He’s clearly guilty if hard evidence were the only materials under consideration—Michael Cohen has already been convicted for the same underlying crime. That part’s been established. If nothing else, he’s prejudicing an upcoming jury pool as well as those that may need to come after this one, were a mistrial to occur. He doesn’t intend to win. He intends to corrupt the process so that the state cannot win. That’s my take on things at this early stage. I’d be interested to hear what others think. As I mentioned in the comments to ARodinFan, Harry Litman was just on Nicolle Wallace's show during her 4:00 hour and raised the spectre of a tainted jury pool. Litman also conjectured that Trump might be betting big on getting back into the Oval Office where all of this legal jeopardy slides off of him.
