Can Hillary sue David Pecker/National Enquirer? [1]

All the print fit so spew...

One of many things coming out of the 34 counts in the Trump incitements, were some of the things Trump was NOT charged with … including witness tampering. In their intelligence gathering, the DA granted immunity to David Pecker (such and appropriate name) in return for his testimony, so he can not be charged with a multitude of conspiracies that are well documented. This Reuters story gives a good summary.

Among the revelations by the DA, and Cohen, was an explicit understanding that Pecker would not only ‘kill’ negative stories about Trump, but “Pecker, who served as publisher of the National Enquirer and chief executive of American Media Inc (AMI), also agreed to publish negative stories about Trump rivals” (From the Reuters summary).

Pecker can not be charged, as per his ‘get out of jail free’ agreement, but I believe he can be sued by Hillary, the DNC, her campaign, and possibly even me (or you). The agreement between trump and Pecker is on the record, and the evidence is most of the front page ‘stories’ in the Globe and Enquirer (as per this 2017 article on qz.com)

The Enquirer is noted for their salacious headlines, and difficult to sue (especially if they print a retraction — of which there are none for the Clinton stories). The malice (one of the requirements for a successful suit) and intent (part of the DA’s summary) exist. Hillary can not get pecker to go to jail, but she can harm him, and his former papers with a painful punishment for their despicable moral decay. If it's good enough for Fox, it’s good enough for the Pecker.

Lawyers, please feel free to tear this blog (and the author) apart.
