And Trump appears to have no defense to that crime.



All the debate about the NY indictments is about whether the misdemeanor falsification of records charge can be raised to a felony because the falsification was done with intent to commit a crime.



Lost in all this pontification is that there is no doubt Trump falsified business records —at least a misdemeanor under NY law — a misdemeanor carrying jail time of up to one year. As explained by Teri Kanefield:

Because the evidence that Trump falsified documents is pretty solid, at the very least we can see 34 misdemeanor convictions for falsifying records.

Even Trump’s lawyers don’t seem to be arguing he didn’t commit the misdemeanor.



NY PL NY PL 175.10 and 175.15 provide:

A conviction for the misdemeanor crime is punishable by as long as one year in jail while the class "E" felony offense has a potential penalty of up to four years in prison.

Do Bragg’s critics think he should have brought the case if he didn’t have support for the felony? Isn’t that saying Trump is above a law that carries up to a year in jail?

Even if the motion to dismiss succeeds for the felony, what basis could they have for dismissing the misdemeanor?

There is firm documentary and other evidence Trump is guilty of a misdemeanor punishable by up to a year in jail.



Absent rebuttal conviction is almost certain.

Can the talking heads talk about that???
