Some states, though, did not take the week off. Before we get to those states’ bills, though, a few updates. The Supreme Court refused to lift the existing injunction in West Virginia re: the state’s new trans kid sports ban. A Federal Judge in the Western District of Tennessee enjoined enforcement of the state’s new Drag Ban for 14 days, until April 13, 2023 until May 26, 2023. Kansas passed a trans kid sports ban (which, by its terms, will apply to a grand total of three kids in Kansas—Bill of Attainder, anyone?); there are some stories out there reporting that “genital checks are required by the bill” but—that’s not what the bill says. There’s no need for hyperbole here, folks. In other news… Florida’s horrible SB254 got even worse, and passed the Senate, and it now goes to the House. This bill: allows Florida courts to take emergency jurisdiction over any child in the state who is undergoing gender transition medical care (hormones, puberty blockers, or surgical). There’s no requirement for there to be a pending custody case or even that the child be a Florida resident; defines TRHC (trans* related health care) as serious physical harm for the purposes of any ongoing custody dispute; prohibits the use of any state funds (e.g., state health insurance plans, etc.) for TRHC for anyone, including adults ; bans TRHC for minors, with exceptions for those still undergoing care, the terms tbd by emergency rules adopted within 60 days of the passage of the bill the bill, as written, becomes effective upon the Governor’s signature, so that’s a pretty significant two month gap they need to clean up requires that any TRHC, even for adults , must be performed by or prescribed by a physician i.e., not a PA, RN, etc…which will seriously limit meaningful access to ongoing care, particularly vis-a-vis hormones What’s the punishment? Well, either disciplinary action or, for any health care professional who violates this provision— a Third-Degree Felony , punishable by up to five years in prison. Not to be outdone, Texas also had its TRHC bill pass the Senate this week (SB14), and it now goes to the House. This bill: prohibits Texas child health plans, medical assistance plans, or Medicaid reimbursement from covering TRHC for minors; bans public funds of any kind from going to any entity that performs TRHC for minors in violation of the bill’s terms; prohibits TRHC for minors, including puberty blockers; the punishment for providing any such care is revocation of the provider’s license; and it permits enforcement by the Attorney General in Austin, Texas, regardless of the location of any alleged violation; Effective date would be September 1, 2023. Legislatures will be back at it next week. Arizona, Indiana, and North Dakota all wrap up their sessions this month, so there’s sure to be a flurry of activity. Keep up the Fight, y’all.
