SCOTUS is out of order [1]

The Clarence Thomas offenses need to be corrected…and soon! But the US judicial system needs more than an exorcism of Thomas to fix the problems. This SCOTUS uses law, logic, and precedent only as means to achieve its ends. In other words, their conclusions are formed in advance, and law, logic, and precedent are simply weapons used to achieve those conclusions. In the meantime, the institution is being trashed. A few examples:

Conservative justices say that the 2nd Amendment, formulated in the time of muskets that took 30 seconds to reload, would disallow legislatures from regulating AR-15s today. This twisted reasoning explodes any logic. Without logic, there is no law.

Another case in point is the SCOTUS treatment of EPA’s regulation of carbon dioxide as a greenhouse gas. EPA says that carbon dioxide emissions are a pollutant that will cause major damage to the health & safety of all of us. Although SCOTUS did rule in favor of EPA (fortunately), Justice Alito said that “Carbon dioxide is not a pollutant”.

It is well known that almost any chemical, in certain concentrations and under certain conditions can cause irreparable harm. EPA is trying to prevent carbon dioxide emissions from reaching those conditions. If Justice Alito doesn’t believe that there are certain circumstances where carbon dioxide can do grievous harm, then he should crawl into a box full of dry ice and lie there for an hour. I believe his thinking would be improved.

SCOTUS is intellectually narrow. Their undergraduate majors were political science, history, English, government, philosophy, and public and international affairs. What’s missing? Science. No sitting justice can claim any understanding of the scientific achievements of the past two thousand years. Why is there so little intellectual diversity on SCOTUS??

Almost every case that comes before SCOTUS has a scientific component. Yet not one of the justices could understand a scientific argument if their life depended on it. Their decisions demonstrate a lack of scientific rigor and we, who pay their salaries, suffer for it.

There simply is no logic that can square with the decisions of these tiny-brained government employees. Time for a lay-off.
