So “Strip Search” Sam puts off Judge Operative Matthew Kacsmaryk's order to ban the drug Mifepristone. The legal logic of the Operative K’s ruling was so twisted you bake it into a pretzel but that is not important, because Kacsmaryk the creep had already decided the outcome before any hearing (which he tried to hide from the public). In the words of Josh Marshall at TPM: ...that traces back to an abiding set of assumptions...that the (Supreme) Court is a legitimate rule-enforcing body which is owed respect and deference...That’s a mistake...The current Court is an illegitimate force in our current public life. It continues to enforce...doctrines that were long hobby horses in right-wing judicial circles...new and ready-made procedures customized to block any and all policy decisions a Democratic president might choose to pursue. And this applies to Federalist Judges and the majority Federalist Appeals Court like the 5th Circus. They really are operatives. Their goal’s are: Keep extremist Republican’s of 2023 in power (Sorry you lost the primary Liz but I’m not surprised). Use the Courts to gradually move American Society into a Christian theocracy (the American Taliban). Maintain the billionaire class ability to buy Politicians (and Judges). The bast*rd SCOTUS Operatives have consistantly revealed their decisions are based on (Republican) politics over and over again and are never called out for it. They reinterpret “the Major questions doctrine” to justify gutting the regulatory authority of Federal Agencies the Republicans do not like. They agree to give a hearing on crackpot sh*t like “The independent state legislature theory” to allow the State GOP to overturn legal elections. And still the American Media clings to the fantasy that anything the Court does is a reason Judicial decision based on precedent and law. Meshuggass. Which brings us to the banning of this drug Mifepristone. It is safe and effective, and the Operatives know this, and normally they would not care. They would write a decision to pull the drug in a New York Minute because they want a society where Women, minorities and the poor are once again second class citizens controled by the White Male Patriarchy (Yes even the Handmaid, the law breaker and the so called moderate). But Sam and his Republican Party also know that the next election is less then 20 months away and banning Mifepristone will effect the entire United States in ways that will make the Dobbs decision seem insignificant. It will make criminals of those who seek to get it by mail from oversea’s where it is legal. It will drive home the idea, once and for all that the American Taliban really want to ban access to abortion services Nation wide, and there is no way the GOP extremist can deny it (not that they won't try). It may (or may not) seriously effect voter turnout in ‘24, so what is Sam and his cronies to do. Continue with his goal to ban the drug, election be d*mned? Split the difference like the 5th Circus did? Or realize the time is not yet right and wait until after the election in hopes that a Republican Administration under T***p, DeSantis or (however unlikely) Scott gets elected. Tough call. But he should in mind that when DeSantis recently signed Florida’s 6 week abortion ban he did so without press in the dead of night. ...the late night, closed door bill signing was a departure from his usual bombastic style and signals the difficult political line he is walking on abortion politics...Restrictions, popular among some conservative GOP primary voters, are seen as potentially damaging among the broader electorate and have led to bruising losses at the ballot box for Republicans in recent months.
