TX abortion-assisting friends of his ex countersuing Marcus Silva [1] ['This Content Is Not Subject To Review Daily Kos Staff Prior To Publication.', 'Backgroundurl Avatar_Large', 'Nickname', 'Joined', 'Created_At', 'Story Count', 'N_Stories', 'Comment Count', 'N_Comments', 'Popular Tags'] Date: 2023-05-16 Mifepristone Doubtless many of us remember Marcus Silva, the ex-husband who sued his wife’s friends in March 2023 under Texas law SB8 for a million dollars apiece, for helping her get a medical abortion. I haven’t seen any stories here on the countersuit, apparently filed by the wife’s friends in early May. So here’s my first diary. As reported by NPR in mid-April, the evidence Silva provided to the police included his ex-wife’s texts with her friends, and close inspection showed they were photographs of the wife’s phone (one taken the same day as a crucial conversation) rather than an electronic version that might have been saved or sent by one of the participants. The countersuit says the friends can prove that Silva found the abortion medication in her purse and replaced it, and photographed the texts, days before she took the medication. "Rather than talking with [his ex-wife] about what he found or disposing of the pill, Silva took photos of the texts and surreptitiously put the pill back," the lawsuit reads. "He wasn't interested in stopping her from terminating a possible pregnancy. Instead, he wanted to obtain evidence he could use against her if she refused to stay under his control, which is precisely what he tried to do." ... He threatened to use the screenshots and evidence he had gathered to have her sent to jail if she didn't "give him my 'mind body and soul' until the end of the divorce, which he's going to drag out," she wrote in text messages to Noyola and Carpenter. She said Silva was asking her to sell the house, give him primary custody of the children and "basically [play] wife." Seems to me this makes him also a party to the abortion, since he didn’t confiscate the pills or try to stop her. It certainly massively undercuts his claim to be horrendously upset and surprised that she had killed his baby. There is already evidence that he was controlling and abusive. Apparently what he really wanted was blackmail material and her under his thumb indefinitely. Gee, I wonder why she didn’t want to stay married to this prince? Comments and related stories of similarly controlling charmers welcomed. I bet there will be lots.
