Special counsel has notes from Trump lawyer that prove Trump knew he couldn't retain classified docs [1]

Most of the buzz around Trump today has centered on E. Jean Carroll announcing that she is after more damages from Trump in response to his attacks on her during the CNN town hall. But a report in The Guardian that has generated far less buzz could potentially be far more damaging to Trump in the long run. According to The Guardian’s Hugo Lovell, special counsel Jack Smith has obtained notes from one of Trump’s lawyers that show Trump was well aware that he had no valid claim to classified documents after he was served with a subpoena demanding their return.

Normally, a prosecutor wouldn’t be allowed to see attorneys’ notes. But these notes come from Evan Corcoran, the Trump lawyer who was forced to give further testimony beyond what he had previously given to the grand jury after Smith convinced a judge that Trump had used Corcoran to commit a crime. Corcoran had earlier given a sworn statement denying that there were any more classified documents in Mar-a-Lago after the National Archives found classified material in the documents it retrieved from Trump in May 2022. However, when the FBI found more classified documents after it descended on Mar-a-Lago, that statement was called into question.

So with attorney-client privilege pierced, Smith has had wider latitude to find out what Corcoran knew and when he knew it—and whether Trump knew it as well. That’s why the discovery of that warning is seismic.
