Trans care "Not deeply rooted in this nation’s history and traditions" says 11th Circuit Court [1] ['This Content Is Not Subject To Review Daily Kos Staff Prior To Publication.'] Date: 2023-08-24 Last Monday all three Trump appointed judges on the Atlanta-based 11th Circuit Court of Appeals echoed the Supreme Court’s in their recent Dobbs decision as a basis to uphold a ban on all gender affirming care for minors in the state of Alabama by ruling that such care for minors is “not deeply rooted in this nation’s history and traditions.” A group of transgender minors and their parents sued the state of Alabama over their recently enacted gender affirming care ban, citing the Fourteenth Amendment guarantee to equal protection and due process, which has been used by other Federal court circuits to strike down legislation passed in other state legislatures acting on their particular flavor of anti-trans hysteria. The Trumpified 11th Circuit Court of Appeals ruled that gender affirming care for minors is “not deeply rooted in this nation’s history and traditions” which is how the six Conservatives on the Trumpified Supreme Court ruled against abortion rights. Alabama's law makes it a crime to provide puberty blockers or hormone treatments to a minor. A U.S. District Court handed down an injunction blocking the law from taking effect last year. Alabama appealed that decision. The litigation will continue as courts assess whether to strike down or uphold the Alabama law permanently. www.usatoday.com/... It should come as no surprise than a far-right court consisting of MAGA judges would use such a patently absurd “Originalist” argument as the justification to strip away the rights of a marginalized group of people who pose absolutely no threat to anyone. Republicans claim that they are “protecting children” with their gender-affirming care bans but who exactly are they protecting? They claim that gender-affirming care such as hormones and puberty blockers are based on “bad science” and presents a risk for minors who cannot speak for themselves. Republican anti-trans hysteria has led an estimated 260,000 transgender Americans and their families to pick up and move to friendlier states such as New York State and California, which have transgender protections enacted into law. Because it has become clear that Republicans are hell-bent on eradicating the transgender community, which to date numbers around 1.5-3 million Americans, or 0.5-1% of the population. And should they somehow gain the White House in 2024, they absolutely will enact broad and draconian anti-trans legislation around the entire country no matter what because that is their goal. Republicans have been quietly slipping anti-trans legislation into must-pass legislation such as the NDAA military spending bill, the national budget, and funding bills for children's hospitals. Some Democrats are even considering caving on these funding bills. However polling among Democrats shows broad support for transgender rights, and recent elections have shown the public is not as interested in anti-trans hysteria as Republicans seem to believe. The entire Republican Party is wildly out of step with the general public, especially among younger voters who are the most LGBTQ+ positive generation in history.
