UPDATE: Proud Boys leader Enrique Tarrio sentenced to 22 years, including "terrorism enhancement" [1] ['This Content Is Not Subject To Review Daily Kos Staff Prior To Publication.'] Date: 2023-09-05 UPDATE: Pointing to Tarrio as the “ultimate leader” of the Proud Boys conspiracy, Judge Timothy Kelly sentenced the ex-Proud Boys leader to 22 years in prison just moments ago. The sentencing guidelines, including “enhanced” sentencing for domestic terrorism, are 27-33 years. x Kelly says the need to send a strong deterrent signal to others is "quite strong." "It can't happen again," he says. "It can't happen again." — Steven Portnoy (@stevenportnoy) September 5, 2023 x "I'm glad he's sorry for what happened to the law enforcement officers that day," Judge says. But, "I don't have any indication that he is remorseful for the actual things he was convicted of, which are seditious conspiracy and conspiracy to obstruct a proceeding." — Greg Walters (@thegregwalters) September 5, 2023 Despite his statements, though, Judge Kelly decided to turn in a sentence significantly lower than that sought by the prosecuting attorneys in this case — nevertheless, Tarrio’s sentence is the longest issued yet in the 1/6 prosecutions: The sentence is by far the longest punishment that has been handed down in the massive prosecution of the riot on 6 January 2021. The Oath Keepers founder Stewart Rhodes, who was convicted of seditious conspiracy in a separate case, had received the longest sentence to date – 18 years. During the sentencing, US district judge Timothy Kelly, who was nominated to the bench by Trump, said the evidence suggested Tarrio was “the ultimate leader” of the seditious conspiracy, “the ultimate person, who organized, who was motivated by revolutionary zeal”. That conspiracy ended up with about 200 men amped up, encircling the Capitol, prepared for battle, led by his codefendants. The judge said Tarrio not being present in Washington on 6 January served some strategic purposes in that it allowed him to attempt to “insulate” himself from what unfolded at the US Capitol. Despite this, Tarrio had an “outsized impact on the events of the day”, Kelly said. - The Guardian (earlier) We are still waiting for the final sentence to be handed down, but Judge Timothy Kelly has rejected ex-Proud Boys leader Enrique Tarrio’s attorney’s plea that the terrorism enhancement (which has been applied to all of Tarrio’s codefendants) not be added in Tarrio’s case: x HAPPENING NOW: Judge Kelly has applied the terrorism enhancement to Enrique Tarrio's upcoming sentence. Parties are still working through the guidelines. — Kyle Cheney (@kyledcheney) September 5, 2023 It certainly seems likely that Kelly will at least hand down a stiff sentence for Tarrio, if not the entire 33 years prosecutors have requested — and he definitely isn’t buying into Tarrio’s shows of remorse: x "Okay, I'll hear him," Judge Kelly says, sighing. "You all have certainly not laid the groundwork for him to step up and say, 'I'm so sorry for committing seditious conspiracy.'" Judge Kelly: "I guess we'll see what he says." — Greg Walters (@thegregwalters) September 5, 2023 Tarrio’s sentence should be announced within the next few hours.
