The National Emergencies Act of 1974 empowers the President to activate special powers during a crisis. Congress can undo a state of emergency declaration, but it would likely require a veto-proof majority.

That being said: If Biden declared Maga a domestic terror threat (pretty clear in light of Jan. 6) -- could he declare national emergency? … no real congress to challenge. .. and railroad moderate or progressive policy on pharma, health care, social security, climate, voter rights etc.?
