Trump plans to use classified information for his defense [1] ['This Content Is Not Subject To Review Daily Kos Staff Prior To Publication.'] Date: 2023-10-27 Trump’s attorneys filed something yesterday that they call “PRESIDENT TRUMP’S CIPA § 5 NOTICE AND OBJECTION TO UNAUTHORIZED DELETIONS OF CLASSIFIED INFORMATION”. Trump thinks this is the “smoking gun” that is going to prove him innocent of all charges. There is no way this will do anything but harm his case. It’s unbelievable that his attorneys would file this and think that it could help him somehow. They must feel like they have nothing to lose at this point. Quote from Case 1:23-cr-00257-TSC, Document 121, Filed 10/26/23: “President Trump will offer classified information at trial relating to foreign influence activities that impacted the 2016 and 2020 elections, as well as efforts by his administration to combat those activities.” They also said: “President Trump will also present classified information relating to the biased and politicized nature of the intelligence assessments that he and others rejected during the events in question.” None of this makes any sense as a defense against the charges in this case. The case is not about the 2016 or 2020 elections. He’s actually saying he’s going to use information from the stolen documents to prove what a great guy he is, and that he was actually trying to save the country, so it was OK for him to have the documents. Or something!!! I truly don’t understand where they are going with this. At the end, the document says: “Collectively, this evidence will undercut central theories of the prosecution and establish that President Trump acted at all times in good faith and on the belief that he was doing what he had been elected to do.” This sounds like something Trump wrote, not any of his lawyers. He’s saying that because he “acted at all times in good faith” (because he was just trying to expose the crooked elections), he’s not liable for stealing classified documents and taking them home with him after he was President. This makes zero sense to me at all legally. He must still be listening to that idiot who tells him that the Presidential Records Act allows him to take anything he wants home with him, including classified material, after his presidency. It looks like Trump and his crack legal team are making things very easy for the prosecutors!
