Trump’s lawyers are using a recent SCOTUS decision that spared the Consumer Financial Protection Bureau to argue that Jack Smith’s appointment as special counsel violates the Appropriations Clause of the Constitution. No, IANAL, so I don’t understand what this has to do with appointing a special counsel, which has happened in the past with no problems. But Trump’s lawyers have been using any crazy argument to kill the MAL documents case, and they have found Her Pissiness to be receptive enough to this argument that she is ordering both sides to prepare for another hearing on June 21st. Judge Aileen Cannon announced on Wednesday that she wants briefs from Trump's lawyers and from prosecutors on the May 16, 2024, decision in Consumer Financial Protection Bureau v. Community Financial Services Association of America, Ltd. In the case, the Supreme Court ruled that the appropriations clause of the U.S. constitution allows Congress to mandate that the Consumer Financial Protection Bureau can be financed by the earnings of the Federal Reserve. In a writing direction, Cannon, a Trump appointee, stated that she wants the briefs "in anticipation of the June 21, 2024, hearing on Defendant Trump's motion to dismiss the indictment based on the unlawful appointment and funding of special counsel Jack Smith." She wrote that both sides must file briefs by June 11 on what effect the Supreme Court decision will have on "Defendant Trump's appropriations clause challenge." I suppose the argument is that because Congress didn’t authorize Jack Smith’s appointment that it should be null and void. And the great legal scholar Her Pissiness is going to look to see if she can dismiss this case because Congress didn’t authorize that money be spent on the special counsel’s work. Given her inherent hostility to the government (see how she acted by appointing a special master to determine if the national security documents were ACTUALLY REALLY THE GOVERNMENTS!), I wouldn’t be surprised if she ruled for Trump in the end. But this will only be after another long delay.
