Some people talk about him being a first time nonviolent offender. Others challenge whether he is actually either of those things. Some say it would be wrong to incarcerate a former president. Others say that being a former president is exactly why he should be incarcerated. Many say that he will get special treatment because he’s a rich white man. Others talk about his continuing criminality and defiance, and his lack of repentance. I would never try to predict what a judge will do, but it's clear to me that Judge Merchan should at least be asking, what would someone not named Donald Trump get for the same crimes? It turns out that this is neither an abstract question, nor a difficult one to answer. Michael Cohen got three years for his role in exactly these crimes. It makes neither logical nor moral sense for the accomplice who repented to get more time than the principle who didn't. So 3 ½ years seems appropriate to me.
