When Clarence was admitted—on merit—to Yale Law School, Affirmative Action was national policy. That was 1971, and he was one of 12 black students to matriculate that year. Now he applies himself to ending programs designed to address longstanding racial inequities. A classic case of pull up the ladder behind me. Via his clerk system, Clarence grooms right-wing candidates for the judiciary, including a recent hire out of his household whose qualifications include a history of racism-inflected statements. In the angels-dancing-on-a-pinhead sophistry applied to gutting the Voting Rights Act, Clarence overlooks the 14th and 15th Amendments’ intention to protect minority rights in general, and voting rights in particular, from states’ rights legislation. “States’ rights” being the most venerable dogwhistle for racist policy. Why did Clarence join the majority in the Citizens United decision? Could recurrent plush vacations and multiple cozy financial arrangements with ultra-rich friends be relevant?
