The Filibuster and Abortion Rights [1]

The Supreme Court gave us Dobbs because Republicans, under the leadership of Mitch McConnell, suspended the filibuster. Trump was able to place three radical anti-abortionists on the Supreme Court because the Republican Party as a whole supported the suspension of the filibuster for that specific purpose. So Republicans have already set the precedent for nuking the filibuster in order to change policy on abortion.

When Republicans say they would not be able to to pass a national abortion ban because they don’t have enough votes in the Senate, they are pretending that they have not already ignored the filibuster to get their way on abortion. Obviously, they would do it again if they got a chance. We need to put a spotlight on this simple fact if we wish to educate the public about the real danger of handing control of the federal government to the MAGA GOP.

Highlighting the Republican history on abortion and the filibuster would buttress a Democratic promise to nuke the filibuster and legislate Roe back into force. This is a position that Democrats should repeat over and over again between now and November.

Paralleling their responsibility for Dobbs is Republican culpability for all the trigger laws that were on the books in various states when Dobbs was decided. While they were dispensing with the filibuster and stacking the Supreme Court with anti-abortion extremists, Republicans were well aware of what ending Roe would entail. They knew that after Dobbs, many states, primarily in the South, would threaten doctors with long prison terms, loss of licenses, and heavy fines if they dared to perform an abortion. Along with Trump and McConnell, all Republican senators are responsible for the suffering of millions of women who are at risk of ceding control over their bodies to Republican politicians in a sizable portion of the of the nation.

It is possible to end this suffering and restore reproductive freedom relatively soon. All it takes for Roe to be back in force in 2025 is Democratic control of the federal government and a targeted disposal of the filibuster.
