The Supreme Court and the 10 commandments [1] ['This Content Is Not Subject To Review Daily Kos Staff Prior To Publication.'] Date: 2024-06-25 So….the Louisiana requirement to post the 10 commandments in every classroom would appear to be a no brainer decision for any court that hears a challenge to it. We have over 200 years of precedent directly on point AND specific language in the US constitution that bars any establishment of state religion. It should’t even get to the Supreme Court. However, the governor of Louisiana is reportedly eager for this case to go to the Supreme Court. It is first rate showboating for the MAGA heads. Furthermore, given that the SC has proven that it will accept ridiculous cases that have been completely dismantled by lower courts such as the presidential immunity issue, there is every reason to think that his law will be overturned in court after court and the governor of Louisiana will simply appeal those losses up the chain to the highest court. If and when this case gets to the supreme court it may well be the case that the Court, (Particularly Alito and Thomas) completely abandon any pretense of respect for precedent or language in the constitution. Indeed both of these justices seem to peevishly and personally relish any decision which distresses “The libs” or anyone that does not agree with them. Thomas and Alito have figured out that there are no meaningful ethics rules to hinder them, and worse, that that nobody can over rule or contradict their rulings if they have a majority. The SC has the final say in any law regarding it’s constitutionality. If they were to decide that the Louisiana law is in fact constitutional there is no higher court to appeal to. Alito and Thomas have abandoned any pretense of integrity or impartiality, and indeed in a very Trumpian way seem to relish posing as victims of the left while engaging in blatant corruption or stunning declarations of personal bias. Effectively the right wing of the court, by Thomas and Alito, can say “The constitution is what WE say it is. WE get the final say and nobody else can do anything about it! We don’t CARE about precedent or the language in the constitution. It says what we say it says and you can’t do a damn thing about it. “ Trust me when I tell you that they would say that with petty vindictive pride.
