[1] ['This Content Is Not Subject To Review Daily Kos Staff Prior To Publication.'] Date: 2024-07-01 The Supreme Court ruled that Trump has immunity for Presidential acts, some official acts, but can be criminally prosecuted for private acts, and remanded the case to the District Court to determine which acts are in which category. In order to accomplish this Judge Chutkan will have to conduct evidentiary hearings at which Jack Smith will be able to submit evidence, and call witnesses to testify. It is assumed that the hearing’s will be widely covered by the media, and each days evidence and testimony will be widely disseminated to the public at large, making the evidence against Trump, even the evidence that would not be admissible a criminal trial, available to the voters. Therefore; Judge Chutkan must conduct the hearings sufficiently before the November 5th election to give her time to issue a written ruling summarizing the evidence and legal justification for her decisions. This will ensure that the voters have the evidence before they cast their votes, and presumably causing Trump to be defeated, and President Biden to be re-elected. Then we will have plenty of time to criminally try and convict Trump after the election, and the immediate threat to our democracy is eliminated. All is well that ends well.
