[1] ['This Content Is Not Subject To Review Daily Kos Staff Prior To Publication.'] Date: 2024-07-01 Today, the Supreme Court summarily decided that the United States required an executive with king like powers, in order to take “bold steps” without fear of future prosecution. www.supremecourt.gov/... Criminally prosecuting a President for official conduct undoubtedly poses a far greater threat of intrusion on the authority and functions of the Executive Branch than simply seeking evidence in his possession. The danger is greater than what led the Court to recognize absolute Presidential immunity from civil damages liability- that the President would be chilled from taking the "bold and unhesitating ac-tion" required of an independent Executive. The dissents overlook the more likely prospect of an Executive Branch that cannibalizes itself, with each successive President free to prosecute his predecessors, yet unable to boldly and fearlessly carry out his duties for fear that he may be next. So I think it is critical to ask, what are some these act THIS court believes are bold? Let me give a few examples I suspect that they want to ensure their leader has the ability to enact with the executive branch/Constitutional basis for the official bold act: Enforce the Comstock Act (Life and Liberty) Declare imminent domain in all areas with oil and declare open for drilling (economic security) Muslim Ban (National Security) Mass deportation (Mass Security) National Guard at all election sites (Election Integrity) Shoot border crossers seeking asylum (national immunity) Accept emoluments from foreign leaders (Gratuity for national security and affairs of state) Audit all political opponents (Revenue generation) Declare estate tax illegal (economic growth) Access social media posts of all Americans and Foreign Nationals (national security, monitoring for terrorist threats) Ignore the NATO Treaty (National Security) These are just a few examples. I could go on for days. I am sure others will have examples below, but I want everyone to be understand the utterly terrifying ramifications of the bordering on evil opinions of the Taney, I am sorry, the Roberts Court.
