According to the plea agreement, filed on Feb. 17, Cavanaugh admitted to parading, demonstration or picketing in a Capitol Building. Cavanaugh will be sentenced on June 10, where he will face a fine of up to $5,000, a maximum of six months in prison and a probation period of up to five years. He must also interview with law enforcement about his activity on Jan. 6 and turn over all his social media accounts for law enforcement review. Additionally, Cavanaugh will pay a restitution fee of $500 for his contribution to the $1.5 million in damages caused by the Jan. 6 riot, according to the agreement. A statement of offense filed in the case says Cavanaugh entered the U.S. Capitol Building around 2:23 p.m. on Jan. 6 and walked through the Capitol Crypt and Capitol Rotunda. “The defendant saw rioters ignore and break the perimeter, fighting law enforcement officers who were attempting to hold the mob back,” the document says. “The defendant knew he should not have gone inside and tried to exit quickly.” Investigators identified Cavanaugh because he was wearing a baseball cap with the name of his now-closed Belgrade Firearm Academy “Tactical Citizen” and through social media posts from Cavanaugh saying he was attending the riot. As part of the plea agreement, three additional felony charges were dismissed, including entering and remaining in a restricted building, disorderly and disruptive conduct in a restricted building and violent entry and disorderly conduct in a Capitol Building. Cavanaugh is among at least six people from Montana to be charged for participating in the Jan. 6 riot. He is one of two people to plead guilty so far. The other is Allen Camper, who pleaded guilty in August and was sentenced to 60 days in jail, 60 hours of community service and a $500 restitution fee.
